Driving with Medical Marijuana in Florida

In Florida, registered medical marijuana patients are allowed to drive with medical marijuana products in their possession, but it is illegal to use or administer these products while in the vehicle. Despite medical marijuana being legal in Florida, it remains a Schedule I substance at the federal level, making it illegal to travel into another state with medical marijuana, even if that state has also legalized it. Law enforcement can only access the Medical Marijuana Use Registry to confirm that a person is a registered patient if they are investigating a violation of law regarding marijuana. There is currently no roadside test or technology that can prove that a person is driving under the influence of medical marijuana; instead, police officers rely on their observations of the driver’s behavior.
